Property and business owners in West Virginia have a legal duty to maintain their premises and to ensure that dangerous conditions do not exist to their customers and guests.  When this duty is violated and injuries occur, the injured party may have a right to compensation.

What to do if you are in a "slip and fall" accident:

1. Get the names, addresses and telephone numbers of any witnesses who may have seen you fall, including any employees present.

2. Make sure the incident is reported to the property owner or the store manager.

3. Try to determine what made you fall, including what any substance may be.

4. If you have a camera or a cell phone camera, take pictures, especially a shot of whatever was on the floor that caused you to trip.  If you do not have a camera, ask someone else to take a picture and send it to you.  Check to see if the store carries disposable cameras.

5. Try to determine where any leaking substance came from.  For instance, was there water leaking from somewhere?  Was it there for an extended period of time?

6. Try to obtain a copy of the incident report prepared by the store manager.

7. Get medical help immediately.

However, the problem could be a defect in the premises itself.  For this reason, an investigation must be conducted as quickly as possible.  This is why its extremely important to contact a West Virginia premises liability attorney to get to work quickly on your case before crucial evidence is lost.  Call JOHN H.
